These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "User," or "you") and Zephyrax Aviation Inc., a corporation registered in Ontario, Canada (VAT: 920584167 RT 0001) ("Company," "we," "us," or "our"), with principal offices at 250 University Ave, Toronto, ON M5H 3E5, Canada.

You are granted a limited, non-exclusive, non-transferable, and revocable license to view and use the Services for your personal, non-commercial purposes.
You agree not to reproduce, distribute, transmit, display, perform, publish, or create derivative works of any content without our prior written consent.
We strive to provide accurate information about our unmanned flight systems and services. However, we make no warranty as to the accuracy, completeness, or reliability of any information or content displayed on our website.
All product descriptions, specifications, and pricing are subject to change without notice. We reserve the right to discontinue or modify any product or service at any time.
Product images are for illustrative purposes only and may not reflect the exact appearance of products received.
When you place an order through our Services, you are making an offer to purchase our products or services. We reserve the right to accept or reject any order at our sole discretion. An order is only confirmed upon receipt of written acceptance from Zephyrax Aviation Inc.
Payment must be made in Canadian dollars (CAD) or as otherwise specified. You agree to provide accurate and complete billing information. All payments must be received in full before delivery, unless a written payment plan has been executed.
Late payments may result in suspension of Services and may affect your access to future orders. Interest on overdue amounts may accrue at a rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.
All prices are exclusive of applicable Harmonized Sales Tax (HST), Goods and Services Tax (GST), Provincial Sales Tax (PST), and other applicable taxes. You are responsible for paying all taxes and fees associated with your order.
Delivery times are estimates only and not guaranteed. Risk of loss or damage to products passes to you upon delivery to the carrier. For orders shipped to Canada, standard shipping is included; expedited options are available at additional cost.
We are not liable for delays caused by carriers, customs, or circumstances beyond our reasonable control. You remain responsible for ensuring someone is available to receive packages.
Products may be returned within 30 days of delivery in original, unused condition with all packaging and documentation. Returns must be approved in writing by Zephyrax Aviation Inc. before shipping.
To initiate a return, contact us at air@zephyrax.bond or +1 416 597 1104 with your order number. You are responsible for return shipping costs unless the return is due to our error or defect. Refunds are processed within 14 business days of receipt and inspection.
Custom orders, installation services, and items damaged by misuse are non-returnable. Opened or used consumables cannot be returned.
We warrant that all products sold are free from defects in materials and workmanship for a period of one (1) year from the date of delivery. This warranty does not cover damage caused by misuse, abuse, negligence, accident, or unauthorized modification.
EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, ZEPHYRAX AVIATION INC. DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZEPHYRAX AVIATION INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Zephyrax Aviation Inc. and its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

We are committed to protecting your personal data in accordance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and Canadian provincial privacy legislation.
Our Services may contain links to third-party websites and resources. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party websites is at your own risk and subject to their terms of service and privacy policies.
We may suspend or terminate your access to the Services at any time, with or without cause, upon notice. Upon termination, your right to use the Services ceases immediately. Sections that by their nature survive termination shall continue in effect.
We may modify these Terms at any time. Changes become effective upon posting to our website. Your continued use of the Services following any modifications constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically for updates.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You hereby consent to the exclusive jurisdiction of the courts located in Toronto, Ontario for any disputes arising from or relating to these Terms or the Services. Each party waives any objection to venue and any claim that such courts are an inconvenient forum.
Before pursuing litigation, the parties agree to attempt to resolve any dispute in good faith through informal negotiation for a period of 30 days.
If informal negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration Act, 1991 (Ontario), before a single arbitrator to be selected by mutual agreement or appointed according to applicable rules.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.
These Terms, together with our Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and Zephyrax Aviation Inc. regarding your use of the Services and supersede all prior or contemporaneous agreements, understandings, and negotiations.
